1. General information

These Terms & Conditions govern the use of the website amavela.pt and the purchase of products from Amavela. By accessing this website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the website or place an order.

3. Scope of application

These Terms & Conditions apply to all sales of physical products offered on amavela.pt.

4. Products and handmade nature

Amavela offers handcrafted and curated eco-friendly products. Due to the handmade and made-to-order nature of the products:

  • Minor variations in colour, texture, shape or finish may occur;
  • Such variations are inherent to the production process and are not considered defects.

Product images are for illustrative purposes only and may differ slightly from the delivered product.

5. Prices and currency

All prices on the website are displayed in EUR (Euro). Amavela operates under the VAT exemption regime pursuant to Article 53 of the Portuguese VAT Code (CIVA). Accordingly, VAT (IVA) is not applicable and is not included in the prices. Prices do not include shipping costs, which are calculated separately and displayed at checkout before order confirmation.

6. Orders

By placing an order, you confirm that:
- You are legally capable of entering into a binding contract; and
- The information provided during checkout is accurate and complete.
Amavela reserves the right to refuse or cancel orders in cases of incorrect or incomplete information, suspected fraud, payment issues, or technical errors affecting pricing or availability.

7. Payment

Payments are processed through third-party payment providers, including PayPal and Revolut Business (card payments). Amavela does not store or process full payment card details. Orders are processed only after payment has been successfully completed.

8. Order processing and shipping

Orders are prepared individually. Order processing time: up to 5 business days. Shipping destinations, delivery times and costs are governed by the Shipping Policy, which forms an integral part of these Terms & Conditions.

9. Delivery

Delivery times provided by carriers are estimates and not guaranteed. Amavela is not responsible for delays caused by events beyond its reasonable control, including but not limited to carrier delays, strikes, weather conditions or force majeure events.

10. Right of withdrawal

Consumers have the right to withdraw from the purchase within 14 calendar days from the day the goods are received, in accordance with EU consumer protection law. The conditions, procedure and limitations of the right of withdrawal are governed by the Returns & Refunds Policy, which forms an integral part of these Terms & Conditions.

11. Returns and refunds

Returns, refunds, exclusions and related procedures are governed by the Returns & Refunds Policy. Amavela reserves the right to refuse returns that do not comply with the conditions described therein.

12. Damaged or defective products

Claims regarding damaged or defective products must be submitted within 48 hours of delivery, in accordance with the Shipping Policy and Returns & Refunds Policy.

13. Liability

Amavela shall not be liable for indirect or consequential damages; losses resulting from misuse of products; minor variations inherent to handmade products; or delays or failures caused by force majeure. Nothing in these Terms limits or excludes liability where such limitation is not permitted by law.

14. Intellectual property

All content on this website, including text, images, logos and designs, is the property of Amavela or its licensors and is protected by applicable intellectual property laws. Unauthorised use, reproduction or distribution is prohibited.

15. Data protection

Personal data is processed in accordance with the Privacy Policy, which forms an integral part of these Terms & Conditions.

16. Complaints

Consumers may submit complaints through the Portuguese Electronic Complaints Book (Livro de Reclamações Eletronico), available at: https://www.livroreclamacoes.pt

17. Applicable law and jurisdiction

These Terms & Conditions are governed by Portuguese law. For consumers resident in the European Union, mandatory consumer protection laws of the consumer’s country of residence shall apply where required by law.

18. Changes to the Terms & Conditions

Amavela reserves the right to amend these Terms & Conditions at any time. The version applicable to each order is the version in force at the time the order is placed.
